Driver’s License Consequences for Adults Pleading to or Convicted of DWAI

• 8 points will be assessed against your Colorado driving privileges.  42-4-1301(1)(b)

If this will be your 1^st DWAI conviction:

• You may be suffer a point suspension for up to one year depending on how many points you have accumulated.

• You may be eligible for probationary license. 42-2-127(12)

• In order for you to reinstate your driving privileges you must pay a $95 fee. 42-2-132(4)(a)(I) and 42-2-132(2)(a)(II)(A) 

If this will be your 2nd conviction for a DWAI in 5 years. 42-2-125(1)(g)(I)

• Your license will be revoked for 1-year. 42-2-125(2.3)

• Your license will be interlock restricted for a minimum of 1 year. 42-2-125(2.4); 42-2-132.5(1); 42-2-132.5(3)(a)

• Under the Persistent Drunk Driver statute, if you have a prior drinking and driving conviction, a prior alcohol revocation, or a BAC over 0.17, you will be required to complete Level II Alcohol and Drug Education and Treatment.  In addition, your license will be interlock-restricted for 2 years. 42-1-102(68.5); 42-2-126(4)(d) (II); 42-2-132(2)(a)(II)(B); 42-2-132.5(1.7)

• In order for you to reinstate your driving privileges you must pay a $95 fee and take a driving test. 42-2-132(4)(a)(I); 42-2-132(2)(a)(II)(A)

• An SR-22 insurance policy will be required. 42-2-132.5(1.5)(b)(II)

If this will be your 3rd DWAI conviction in your life:

• Your license will be revoked for 2 years.  However, you may apply for early reinstatement with an interlock-restricted license after one year. 42-2-125(1)(i); 42-2-125(2.4); 42-2-132.5(1); 42-2-132.5(1.5)(a); and 42-2-132.5(3)(a)
