DUI Penalties - Determining DUI penalties is very complex and the laws change frequently.  While Judges across Colorado try to treat similarly-situated defendants equally, each judge has individual sentencing habits.  The following are general guidelines only and you should not rely on them for what may happen in your specific case.  I can give you more detailed advice when you call me. 

Every person convicted of DUI, DUI per se may be punished by:

Jail – Jail is mandatory in certain situations.  In less serious cases the court may have discretion to impose and then suspend a jail sentence on the condition that you do everything else the Court requires and you do not pick up any new violations.  Some judges allow jail time to be served at home with an electronic monitor attached to your hard-line phone.  (in Home detention / IHD).  Many judges will authorize you to go to work if jail time or IHD is imposed.

Fees – Probation supervision fess of approximately $50 per month.

Fines - In the court’s discretion.

Costs – Court costs which usually run about $500 on a first offense.

Alcohol education and alcohol therapy classes

Prior convictions or deferred sentences at any time in your life, no matter whether a Colorado case or not, may increase the penalties.
