"I appreciate you taking my call yesterday and I slept much better last night after speaking with you. JN"

"Endorsement from lawyer, John Buckley, Denver (CO). Gary Pirosko is not only a leader in the Colorado community of DUI defense attorneys but also one of the national experts in this arena. If I have a practice question, Gary is on the short list of resources I contact. His knowledge is not only based on his extremely professional representation of his clients but also his past positions as a former prosecutor and deputy sheriff.

“Congrats my friend. This honor is well deserved!” FD.

“This is a beautifully presented piece of excellent information. Thank you so much for taking the time to respond!” MO - Criminal defense attorney

Driver’s License Restraints

Revocation:  A mandatory restraint action on a valid driver's license or driving privilege.  A revoked license is invalid and cannot be re-issued.  After reinstatement of your driving privilege you must re-test (both written and drive) to be issued a new license.

Suspension:  A temporary withdrawal of the driving privilege.  A suspension is a restraint action but does not void the driver's license.  A valid license may be re-issued upon reinstatement.  A license that has expired must be renewed upon reinstatement.  Point suspensions require a written test at renewal.

If you accumulate too many points from convictions on tickets within a certain period of time, you will lose your driver's license through a point suspension.  You will be notified of a hearing date which will determine the length of the restraint.  A suspension can be ordered for up to one year and a probationary license may or may not be authorized at the hearing.  Points are counted from the day you received your traffic ticket, not the day you resolve the matter by paying the fine or plead guilty in court.  The following are point accumulations that result in suspension:

Adult Driver (21 and older):  12 points in any 12 consecutive months.  18 points in any 24 consecutive months.

Minor Driver (18 thru 20 years of age):  9 points in any 12 consecutive months. 12 points in any 24 consecutive months.  14 or more points between the ages of 18-21

Under the Age of 18:  6 points in 12 consecutive months.  7 points prior to turning 18

Colorado does not have what is commonly referred to as a chauffeur license however, if a driver proves at a hearing that they are employed as a driver and received all of their tickets in the course of their employment , they are not subject to suspension until they receive 16 points in 12 months, 24 points in 24 months or 28 points in 4 years.

Denial:  A restraint action when no valid license exists at the time of restraint.

Cancellation/Denial:  Actions to void a Colorado license and deny the driving privilege.  Reinstatement is required and passing of a written and a road test is mandatory.

Cancellation:  This action will void a valid Colorado license.  A cancellation by itself is not a restraint action and does NOT require reinstatement if complied with in a timely manner.  Another license/permit may be issued, unless the reason for cancellation is still outstanding.
